Is it possible to apply for a passport in Canada and cross the border?

Your boyfriend was convicted of a crime and sentenced to do community service. He has since committed two more crimes by a) failing to adhere to the terms of his sentence b) failing to reappear in court. Judges don't like to be ignored. From what you're saying, I would strongly suspect that there is an outstanding bench warrant for his arrest. Bench warrants don't expire. The police may not be actively looking for him, but the warrant is in the system. The only way to know for sure is to go to the police - with or without legal representation, but preferably with - and ask. If the answer is "yes", then he will be arrested. That's the purpose of a warrant - it's an order from a judge to arrest someone. There's no grey area. As for the question of obtaining a passport and travelling to the US - if there is in fact an outstanding bench warrant for his arrest, what you're proposing is to commit yet another crime, and this time a federal one - fleeing the country to avoid arrest. There may be extenuating circumstances here that would lead to leniency - if your boyfriend was a juvenile when first convicted or something. The fact that he was only given community service for theft makes it seem like it was a fairly minor incident and/or first time offense. Unfortunately for both of you, he has compounded the problem by showing contempt for the court. He could have gone back to court at the time and asked to do his community service in Ottawa. Either way, it seems like he has two choices - continue to live under a cloud, or step up and face the music.
